During the hearing CSX counsel asked Smith whether he had been "taken out of service" in the course of his visit to the safety meeting, which is a violation of the company's rules. In cross-examination Smith claimed that two of his supervisors had informed them that they'd seen him dismounting moving equipment which was a violation of safety guidelines.
